Volaris: Rights & Compensation on Flights Departing from the US

No regulations require airlines to financially compensate passengers for domestic flights in the US that are delayed or canceled. However, you may be entitled to a refund, and some airlines offer certain forms of compensation. Additionally, assistance is usually provided, including rebooking on the next available flight, meal vouchers, and hotel accommodation in the event of an overnight cancellation. Let's take a detailed look at your rights in the case of delayed or canceled Volaris flights under DOT regulations.

Right to a Refund

In cases of a delayed or canceled Volaris flight, you may be entitled to a ticket refund:

  • Canceled flight: Regardless of the reason for the cancellation, you are entitled to a refund if you choose not to travel.

  • Delayed flight: If your flight is significantly delayed, you are entitled to a refund from the airline if you choose not to fly.

Until recently, there was no general definition of a "significant delay," as it was determined on a case-by-case basis. The new regulation, which came into effect in late 2024, provides a clearer definition of a significant delay:

  • A delay of three hours or more for domestic flights

  • A delay of six hours or more for international flights.

In these cases, passengers are entitled to an automatic ticket refund

If Your Plane is Delayed on the Tarmac

Under DOT regulations, if your plane is delayed on the tarmac:

  • After 2 hours, passengers must be provided with food, water, operational lavatories, and, if needed, medical care.

  • Passengers have the right to deplane after 3 hours for domestic flights and 4 hours for international flights unless there are safety or security reasons.

Learn more about your rights during tarmac delays here.

When Is Compensation Applicable Under US Law?

For delays and cancellations, passengers are not entitled to compensation under DOT regulations. If your Volaris flight experienced a significant delay, you are eligible for a ticket refund. Any additional compensation (such as cash, travel vouchers, or frequent flyer miles) may be offered by the airline but is not mandatory.

The Department of Transportation (DOT) mandates monetary compensation in the following cases:

In the event of a Volaris flight cancellation, passengers are typically offered an alternative flight to their destination or the option of a full refund. However, under EU laws, if the cancellation occurs less than 14 days before the scheduled departure from a European airport, affected passengers may be entitled to compensation for canceled flights from Volaris of up to $650 per person.
